    Bill Summary

    This bill creates the Class E felony offenses of:

    (1) Engaging in sexual conduct or contact with an animal;

    (2) Aiding or causing another person to engage in such contact;

    (3) Permitting such activity on any premises under his or her charge or control;

    (4) Participating in, organizing, promoting, conducting, advertising, aiding, abetting, observing, or providing a service in furtherance of such sexual activity for commercial or recreational purpose; and

    (5) Photographing or filming, for sexual gratification, a person engaging in sexual activity with an animal.

    This bill's prohibition against sexual activity with animals applies to both live and dead animals.

    In addition to the punishment for the Class E felony, a court may order that a person convicted of one of the above offenses:

    (1) Abstain from owning or harboring animals or from living in any household where animals are present;

    (2) Undergo counseling at the defendant's expense; and

    (3) Reimburse the animal shelter or humane society for any expenses incurred for the care and maintenance of any animals taken to the animal shelter or humane society as a result of a court order that requires the defendant to abstain from owning or harboring animals.

    ON APRIL 2, 2007, THE SENATE ADOPTED AMENDMENTS #1 AND #2 AND PASSED SENATE BILL 487, AS AMENDED.

    AMENDMENT #1 specifies that this bill's prohibition against sexual activity with an animal applies to any animal other than man, including fowl, birds, reptiles and fish, wild or domestic, living or dead. Also, this amendment applies this bill's prohibitions against sexual conduct and sexual contact with animals to any physical sexual contact between the person and the animal.

    AMENDMENT #2 corrects a typographical error in Senate Amendment #1.
