    Bill Summary

    This bill increases various court fees by $2.00 to fund computed related expenses and data entry as described below. However, the $2.00 increase of fees pursuant to this bill would not be assessed against the state or otherwise represent a cost to the state in criminal cases, child support actions, mental health proceedings, actions under the Tennessee Adult Protection Act, actions with regard to child care licensing, or collection efforts brought by the department of human services.

    Under present law, out of all the general filing fees charged by court clerks, $2.00 of the amount collected is earmarked for computer hardware purchases or replacement or for other usual and necessary computer related expenses at the discretion of the clerk. Such amount must be preserved for these purposes and may not revert to the general fund at the end of a budget year if unexpended.

    This bill requires that all the general filing fees charged by court clerks, effective July 1, 2012, be increased by $2.00. Such $2.00 increase would be additionally earmarked for computer hardware purchases or replacement or for other usual and necessary computer related expenses at the discretion of the clerk and would be preserved for those purposes and not revert to the general fund at the end of a budget year if unexpended.

    Present law authorizes each court clerk, in each new case filed and at the clerk's option, to charge an additional $2.00 fee for data entry. This bill increases this additional fee to $4.00.

    ON APRIL 25, 2012, THE SENATE SUBSTITUTED HOUSE BILL 2633 FOR SENATE BILL 2853, ADOPTED AMENDMENT #1, AND PASSED HOUSE BILL 2633, AS AMENDED.

    AMENDMENT #1 schedules the $2.00-increases implemented by this bill to terminate on July 1, 2016, unless continued by the general assembly. If the increases are not continued, then the applicable provisions of law that existed immediately prior to the enactment of this bill will be revived and be in affect as the existed immediately prior to July 1, 2012.
