Military - As enacted, clarifies that when persons are engaged in national guard active duties no private employment benefits may be curtailed or made ineligible due to such duties; specifies members to whom act applies and benefits to which act applies. - Amends TCA Title 8, Chapter 33, Part 1.

    Bill Summary

    Under present law, all officers and employees of this state, or any department or agency thereof, or of any county, municipality, school district, or other political subdivision, all other public employees of this state and all private sector employees who are, or may become, members of the Tennessee state guard and civil air patrol are entitled to an unpaid leave of absence from their respective duties, without loss of time, pay, regular leave or vacation, or impairment of efficiency rating, for all periods of service during which they are engaged in the performance of duty or training in the service of this state, under competent orders.

    This bill extends the scope of what is protected during any unpaid leave for service in the state guard or civil air patrol to include any job-related benefit, including, but not limited to, the benefits that are protected under present law plus position and supplemental pay. This bill also specifies that the entitlement to unpaid leave applies when service in the state guard or civil air patrol in an emergency.

    ON MARCH 5, 2012, THE HOUSE ADOPTED AMENDMENT #1 AND PASSED HOUSE BILL 2295, AS AMENDED.

    AMENDMENT #1 clarifies that this bill applies to employees who are members of the Tennessee army and air national guard on active state duty or the Tennessee state guard and civil air patrol. This amendment also revises the pay and other benefits that would be unaffected by the leave of absence, to specify that person would not suffer loss of time, pay not specifically related to leave of absence time, regular leave or vacation or impairment of efficiency rating. This amendment specifies that the leave provided by this bill is in addition to the leave provided under present law for reservists.
