Criminal Offenses - As introduced, revokes the beer permit and license to sell tobacco products and prohibits renewal of lottery retail contract for a period of one year if the owner or employee of a retail establishment is convicted of selling certain synthetic, analogue or imitation controlled substances. - Amends TCA Title 4, Chapter 51; Title 39, Chapter 17, Part 4; Title 57, Chapter 5, Part 1 and Title 67, Chapter 4, Part 10.

    Bill Summary

    Under present law, it is a Class A misdemeanor for a person to knowingly produce, manufacture, distribute, sell, or possess with intent to produce, manufacture, distribute, or sell, unless lawfully prescribed or approved by the FDA:

    (1) Any amount of certain synthetic derivatives or analogues of methcathinone; or
    (2) The active chemical ingredient in the hallucinogenic plant salvia divinorum or certain synthetic cannabinoids,

    This bill specifies that in addition to any other penalty for a violation of the offenses described above in (1) and (2), if the violation of such an offense involves the sale, offer for sale, or possession with the intent to sell or offer for sale any product prohibited by such offense by the owner or an employee of a retail establishment from within the confines of such establishment, then the following would apply if applicable to the establishment:

    (1) The establishment's lottery retailer contract may not be renewed by the Tennessee lottery corporation for one year from the date of the conviction and no lottery retailer certificate of authority may be issued to such establishment during such one-year period;
    (2) The court must revoke the establishment's license to sell or distribute tobacco products for one year from the date of the conviction and must notify the department of revenue of such revocation; and
    (3) The court must revoke the establishment's permit to sell beer for one year from the date of the conviction and must notify the appropriate local beer board of such revocation.
