Education, Higher - As enacted, declares that teacher effect data made available to teacher preparation programs are not public records and will be used only in evaluating the preparation programs; requires each institution or postsecondary system receiving the estimates to develop a policy to protect the confidentiality of the data. - Amends TCA Section 49-1-606.

    Bill Summary

    Under present law, data from the TCAP tests is used to provide an estimate of the statistical distribution of teacher effects on the educational progress of students within school districts for grades three through eight. The estimates of specific teacher effects on the educational progress of students is not to be a public record, and may be made available only to the specific teacher, the teacher's appropriate administrators as designated by the LEA and school board members. The estimates of specific teacher effects may also be made available to the state board approved teacher preparation programs of individual teachers. The estimates made available to the preparation programs must not be personally identifiable with a particular teacher.

    This bill replaces the present law requirement that the estimates made available to the preparation programs must not be personally identifiable with a particular teacher with a requirement that such estimates are not a public record and shall be used only in evaluation of the respective preparation programs.

    ON MARCH 22, 2012, THE HOUSE SUBSTITUTED SENATE BILL 3024 FOR HOUSE BILL 3469, ADOPTED AMENDMENT #1, AND PASSED SENATE BILL 3024, AS AMENDED.

    AMENDMENT #1 requires each institution or postsecondary system receiving the estimates to develop a policy to protect the confidentiality of the data.
