    Bill Summary

    This bill revises the present law provisions governing leave from employment for certain persons serving in the military.

    EMPLOYEES TO WHOM LEAVE PROVISIONS APPLY

    Under present law, all officers and employees of this state, or any department or agency thereof, or of any county, municipality, school district, or other political subdivision, and all other public employees of this state who are members of any reserve component of the armed forces of the United States, including members of the Tennessee army and air national guard, are entitled to a leave of absence from their respective duties, without loss of time, pay, regular leave or vacation, impairment of efficiency rating, or any other rights or benefits to which otherwise entitled, for all periods of military service during which they are engaged in the performance of duty or training in the service of this state, or of the United States, under competent orders.

    This bill extends the above leave provision to private sector employees who are reservists. This bill also adds identical leave provisions for the above-described employees, including private sector employees, who are in the state guard and civil air patrol.

    PAID LEAVE DAYS

    Under present law, in regard to the above-described leave, an officer or employee on such leave will be paid salary or compensation for a period, or periods, not exceeding 20 working days in any one calendar year, plus such additional days as may result from any call to active state duty. The military leave is unaffected by date of employment or length of service and has no effect on other leaves provided by law, regulation, policy or practice. After the 20 working days of full compensation, any public employer may provide partial compensation to its employees while under competent orders.

    This bill removes all of the above-described provisions.

    ON MAY 21, 2011, THE SENATE ADOPTED AMENDMENT #1 AND PASSED SENATE BILL 1996, AS AMENDED.

    AMENDMENT #1 rewrites this bill to provide an unpaid leave of absence for members of the Tennessee state guard and civil air patrol. Under this amendment, all officers and employees of this state, or any department or agency of the state, or of any county, municipality, school district, or other political subdivision, all other public employees of this state and all private sector employees who are, or may become, members of the Tennessee state guard and civil air patrol will be entitled to an unpaid leave of absence from their respective duties, without loss of time, pay, regular leave or vacation, or impairment of efficiency rating, for all periods of service during which they are engaged in the performance of duty or training in the service of this state, under competent orders.
