    Bill Summary

    This bill revises the present law provisions governing the display of the P.O.W.-M.I.A. flag.

    Under present law:

    (1) The P.O.W.-M.I.A. flag must be displayed over the state capitol at least during Tennessee P.O.W.-M.I.A. Recognition Week; and
    (2) Any individual or group may donate a P.O.W.-M.I.A. flag to a county, city or state government and request that it be flown at a public building designated by such individual or group.

    This bill rewrites the above provisions to require that the P.O.W.-M.I.A. flag be displayed over the state capitol on any day that the United States flag is displayed. This bill also requires the display of such flag at the following locations on any day the U.S. flag is displayed: the courthouse or other building that serves as the main administrative building of each county, and the building that serves as the city or town hall or main administrative building of each municipality.

    ON APRIL 21, 2011, THE SENATE ADOPTED AMENDMENT #1 AND PASSED SENATE BILL 1405, AS AMENDED.

    AMENDMENT #1 makes this bill permissive by authorizing the flying of donated P.O.W.-M.I.A. flags over local administrative buildings on dates when the U.S. flag is flown over such buildings.

    ON MAY 2, 2011, THE HOUSE SUBSTITUTED SENATE BILL 1405 FOR HOUSE BILL 2017, ADOPTED AMENDMENT #2, AND PASSED SENATE BILL 1405, AS AMENDED.

    AMENDMENT #2 specifies that when the POW-MIA flag is displayed on the state capitol or on a courthouse or local government administrative building on the same pole with the U.S. flag and the Tennessee state flag, the POW-MIA flag will be displayed below the U.S. flag and the Tennessee state flag.
