Education, Dept. of - As enacted, specifies that the commissioner may appoint to the state-level safety team a representative from "directors of schools, members of local boards of education, public school teachers, school counselors and psychologists, and parents of students enrolled in public schools" instead of from "the Tennessee organization of school superintendents, the Tennessee school boards association, the Tennessee education association, and the Tennessee state parent teacher association." - Amends TCA Title 49, Chapter 6, Part 8.
Companion bill has been assigned Public Chapter Number 428 by the Secretary of State.

    Bill Summary

    This bill adds a representative of the Professional Educators of Tennessee to the current eligibility list for appointment by the commissioner of education to the state-level safety team to assist with compliance with the Schools Against Violence in Education Act (SAVE Act).

    Present law requires the commissioner of education to establish a state-level safety team to assist LEAs and schools with compliance with the SAVE Act as reasonably necessary. Generally, the SAVE Act requires each LEA to adopt a comprehensive district-wide school safety plan and building-level school safety plans regarding crisis intervention, emergency response, and emergency management.

    Present law requires the commissioner to appoint the members of the state-level safety team, including:
    (1) A representative of the department of safety;
    (2) A representative of the Tennessee bureau of investigation;
    (3) A representative of homeland security;
    (4) A representative of the department of mental health;
    (5) A representative of the emergency medical services of the department of health;
    (6) A representative of the state board of education;
    (7) A representative of the Tennessee association of school resource officers; and
    (8) A representative of the department of intellectual and developmental disabilities.

    Present law also authorizes the commissioner to appoint a representative from each of the following:
    (1) The Tennessee organization of school superintendents;
    (2) The Tennessee school boards association;
    (3) The Tennessee alternative education association;
    (4) The Tennessee education association;
    (5) The Tennessee association of mental health organizations;
    (6) The Tennessee association of school counselors and psychologists;
    (7) The Tennessee state parent teacher association;
    (8) Tennessee students between 16 and 24 years of age; and
    (9) The Tennessee school health coalition.

    This bill adds that the commissioner may also appoint a representative from the Professional Educators of Tennessee to the state-level safety team.

    ON MARCH 24, 2011, THE HOUSE ADOPTED AMENDMENT #1 AND PASSED HOUSE BILL 146, AS AMENDED.

    AMENDMENT #1 rewrites the bill to specify that the commissioner of education may appoint to the state-level safety team, described in the above summary, a representative from "any professional employees' organization whose members are licensed employees of LEAS."

    ON MAY 21, 2011, THE SENATE SUBSTITUTED HOUSE BILL 146 FOR SENATE BILL 873, ADOPTED AMENDMENT #1, AND PASSED HOUSE BILL 146, AS AMENDED.

    AMENDMENT #1 rewrites the bill to specify that the commissioner of education may appoint to the state-level safety team, described in the above summary, a representative from "directors or schools, members of local boards of education, public school teachers, school counselors and psychologists, and parents of students enrolled in public schools" instead of from "the Tennessee organization of school superintendents, the Tennessee school boards association, the Tennessee education association, and the Tennessee state parent teacher association", as described in the above bill summary in (1), (2), (4), (6), and (7).
