Drugs, Over the Counter - As enacted, creates Class A misdemeanor of producing, manufacturing, selling or offering to sell any product containing any of six listed synthetic derivatives or analogues of the Schedule I controlled substance methcathinone. - Amends TCA Title 39, Chapter 17, Part 4.

    Bill Summary

    Under present law, it is an offense for a person to knowingly manufacture, deliver, or sell a controlled substance or to possess a controlled substance with intent to manufacture, deliver, or sell the substance. The punishment for such offense varies depending on the type or amount of controlled substance used. If the offense is committed with respect to the Schedule I controlled substance methcathinone, then the offense is a Class B felony and, in addition, the defendant may be fined up to $100,000.

    This bill makes it a Class A misdemeanor for a person to knowingly produce, manufacture, distribute, sell, or offer to sell any product containing any of the following synthetic derivatives or analogues of the Schedule I controlled substance methcathinone:

    (1) 3,4-Methylenedioxymethcathinone (Methylone);
    (2) 3,4-Methyenedioxypyrovalerone (MDPV);
    (3) 4-Methylmethcathinone (Mephedrone);
    (4) 4-Methoxymethcathinone (Methedrone);
    (5) 4-Fluormethcathinone (Flephedrone); and
    (6) 3-Fluoromethcathinone (3-FMC).

    This bill would not apply to drugs or substances that are lawfully prescribed or that have been approved by the FDA.

    ON APRIL 18, 2011, THE HOUSE ADOPTED AMENDMENT #1 AND PASSED HOUSE BILL 457, AS AMENDED.

    AMENDMENT #1 changes this bill's effective date from "July 1, 2011" to "upon becoming law."
