    Bill Summary

    This bill specifies that a bovine owner would not be liable for any injury, loss, damage, or death of a person resulting from the inherent risks of bovine activities if the bovine owner:
    (1) Posts and maintains proper warning signs on or near stables, corrals, fences, enclosures or arenas where the owner conducts bovine activities. The sign must state that "under Tennessee law, a bovine owner is not liable for any injury, loss, damage, or death of a person resulting from the inherent risks of bovine activities;"
    (2) Posts and maintains proper fences and enclosures, pursuant to present law; and
    (3) Does not commit an act or omission that constitutes willful or wanton disregard for the safety of the person and that causes the injury, loss, damage, or death.

    Generally, present law specifies when and if a landowner is liable to persons using the landowner's land for certain recreational activities. This bill specifies that such present law would not apply to a bovine owner if the injury, loss, damage or death resulted from a bovine activity.

    ON MARCH 3, 2011, THE SENATE ADOPTED AMENDMENT #1 AND PASSED SENATE BILL 339, AS AMENDED.

    AMENDMENT #1 changes the standard of conduct that, when applied to an act or omission committed by a bovine owner that causes injury, loss, damage, or death, will not be eligible for prevention or limitation of liability under this bill from "willful or wanton disregard for the safety of the person" to "negligent disregard for the safety of the person".

    ON MARCH 17, 2011, THE HOUSE SUBSTITUTED SENATE BILL 339 FOR HOUSE BILL 567, ADOPTED AMENDMENT #1, AND PASSED SENATE BILL 339, AS AMENDED.

    AMENDMENT #1 removes the provisions of Senate Amendment #1, thereby restoring the bill to its introduced version whereby "willful or wanton disregard for the safety of the person" will remove the protection from liability.
