  • Fiscal Summary

    (CORRECTED) Increase State Expenditures - $52,000/FY13-14 and Subsequent Years Increase Federal Expenditures - $1,232,742,500/FY13-14 and Subsequent Years Other Fiscal Impact - Beginning in FY13-14, the state will take over the administration of and benefits provided through the Medicare program reflecting a total shift to Tennessee of approximately $11,505,596,700 in federal funds. Of this amount, $10,272,854,200 is for services currently provided to Tennessee citizens and $1,232,742,500 is for administrative costs currently incurred by the federal government that will be redirected to Tennessee for administrative purposes (shown as Increased Federal Expenditures above). This shift will not change the total amount of federal funds being spent on the program. The total amount of services and covered benefits that enrollees are receiving will remain unchanged. The program will remain 100 percent federally funded.


    Bill Summary

    This bill enacts the Health Care Compact which:
    (1) Specifies that each member state of the compact would have the authority to enact state laws that supersede any and all federal laws regarding health care within its state;
    (2) Specifies that each member state would have the right to mandatory federal funds to support the exercise of member state authority under this compact and that this funding would not be conditional on any action, regulation, policy, law, or rule of any kind of the member state. According to an appendix of the Compact, in 2010, such federal funding in Tennessee was $16.389 billion; and
    (3) Creates the interstate advisory health care commission, described below.

    Under this bill, the interstate advisory health care commission would consist of members appointed by each member state through a process to be determined by the laws of each member state. No state may appoint more than two members to the commission, and at any time a member state may withdraw its members from the commission.

    The commission may not act unless a majority of the members are present, and no action would be binding on the commission unless approved by a majority of the total number of members. The commission will meet at least once a year.

    The commission may study the issues of health care regulation of particular concern to the member states, such as the elimination of interstate barriers to the provision of health care. After consideration, the commission may make nonbinding recommendations to the member states.

    Additionally, the commission would collect information and data to assist the member states in their regulation of health care, including assessing the performance of various state health care programs and compiling information on the cost of health care. The commission would make this information and data available to the legislatures of the member states.

    ON MAY 16, 2011, THE SENATE ADOPTED AMENDMENTS #1, #2, #3 AND #4 AND RESET SENATE BILL 326, AS AMENDED.

    AMENDMENT #1 redefines "health care" to mean care, services, supplies, or plans related to the health of an individual and includes but is not limited to:

    (1) Preventive, diagnostic, therapeutic, rehabilitative, maintenance, or palliative care and counseling, service, assessment, or procedure with respect to the physical or mental condition or functional status of an individual or that affects the structure or function of the body;
    (2) Sale or dispensing of a drug, device, equipment, or other item in accordance with a prescription; and
    (3) An individual or group plan that provides, or pays the cost of, care, services, or supplies related to the health of an individual, except any care, services, supplies, or plans provided by the United States Department of Defense and United States Department of Veteran Affairs, or provided to Native Americans.

    This amendment clarifies that members states will take joint and separate action to secure the consent of the United States Congress to this compact in order to return the authority to regulate health are to the member states consistent with the goals and principles articulated in this compact.

    This amendment rewrites the "state control" provisions of the compact to provide that each member state, within its state, may suspend by legislation the operation of all federal laws, rules, regulations, and orders regarding health care that are inconsistent with the laws and regulations adopted by the member state pursuant to this compact. Federal and state laws, rules, regulations, and orders regarding health care will remain in effect unless a member state expressly suspends them pursuant to its authority under this compact. For any federal law, rule, regulation, or order that remains in effect in a member state after the effective date, that member state will be responsible for the associated funding obligations in its state.

    This amendment also rewrites the '"funding" provisions of this compact to provide that each Federal fiscal year, each members state will have the right to federal monies up to an amount equal to its member state current year funding level for that federal fiscal year, funded by congress as mandatory spending and not subject to annual appropriation, to support the exercise of member state authority under this compact. This funding will not be conditional on any action of or regulation, policy, law, or rule being adopted by the member state. By the start of each federal fiscal year, congress must establish an initial member state current year funding level for each member state, based upon reasonable estimates. The final member state current year funding level will be calculated, and funding will be reconciled by congress based upon information provided by each member state and audited by the U.S. government accountability office.

    This amendment specifies that no member state or the commission may disclose health information of any individual.

    This amendment revises the provisions governing an amendment to the compact to specify that member states may amend the compact without prior approval from congress and such amendments will be effective unless, within one year, congress disapproves the amendment.

    In regard to withdrawal from the compact, this amendment rewrites to specify that any member state may withdraw from this compact by adopting a law to that effect, but no such withdrawal will take effect until six months after the governor of the withdrawing member state has given notice of the withdrawal to the other member states. A withdrawing state will be liable for any obligations that it may have incurred prior to the date on which its withdrawal becomes effective.

    AMENDMENT #2 schedules the health care compact for sunrise review on June 30, 2013.

    AMENDMENT #3 corrects a typographical error.

    AMENDMENT #4 requires that, if the state participates in the Interstate Advisory Health Care Commission, the funds necessary for the state to perform the duties as a member state to the Interstate Advisory Health Care Commission must be earmarked from the administrative fees from Federal monies received by the state. This amendment also specifies that the state is authorized to decline to participate in the Interstate Advisory Health Care Commission and pay for the costs of administering health care in the state, in lieu of administration costs of the commission, by use of the administrative fees received from Federal monies.

    ON MAY 18, 2011, THE SENATE FURTHER CONSIDERED SENATE BILL 326, AS AMENDED BY AMENDMENTS #1, #2, #3 AND #4, AND PASSED SENATE BILL 326, AS AMENDED.

    ON MAY 1, 2012, THE HOUSE SUBSTITUTED SENATE BILL 326 FOR HOUSE BILL 369, ADOPTED AMENDMENTS #2, 4, 7, 8, 9, 10, AND 5 AND PASSED SENATE BILL 326, AS AMENDED.

    AMENDMENT #2 specifies that a domestic or foreign business or nonprofit corporation (other than the corporation or an entity controlled by the corporation) of which the director or officer is a director will be considered a "related person" for purposes of this bill only with respect to a transaction or proposed transaction to which the corporation and the other business or nonprofit corporation are parties or proposed parties and that is a transaction or proposed transaction that is or should be considered by the board of directors of the corporation.

    This amendment also removes the requirement that a vote on action affecting a director's conflict of interest transaction must be taken outside the presence of any disqualified directors in order to limit liability based on the transaction.

    AMENDMENT #4 specifies that Tennessee would not participate in this compact, if participation includes expanding abortion rights, specifically, late term abortions.

    AMENDMENT #7 specifies that if Tennessee joins this compact, then no provision of this compact would authorize or in any manner permit the state from taking any action that would diminish, dilute or any manner abridge the rights and benefits of veterans under any health care programs affecting veterans, as such programs exist on the effective date of this bill.

    AMENDMENT #8 specifies that if Tennessee joins this compact, then no provision of this compact would authorize or in any manner permit the state from taking any action that would diminish, dilute or any manner abridge the rights and benefits of elder and other citizens under Medicaid or TennCare as such programs exist on the effective date of this bill.

    AMENDMENT #9 specifies that if Tennessee joins this compact, then no provision of this compact would authorize or in any manner permit the state from taking any action that would diminish, dilute or any manner abridge the rights and benefits of elder citizens under Medicare as such program exists on the effective date of this bill.

    AMENDMENT #10 authorizes, instead of requires, Tennessee to become a party to the health care compact.

    AMENDMENT #5 specifies that Tennessee would not participate in this compact, if participation includes the adoption of any United Nations (UN) Health Plans.
