    Bill Summary

    Under present law, if a member of the Tennessee national guard dies in the line of duty, then the adjutant general's office must notify the governor, and in any month in which one or more death notifications are provided, the governor must proclaim a day of mourning to honor the deceased member or members and order the state flag to be flown at half-staff over the state capitol during the day of mourning.

    This bill requires the governor to notify the executive official of the political subdivision in which a Tennessee national guard member who was killed in action had resided of the deceased member's identity and the date of the day of mourning. The executive official of the political subdivision would order any state flag on the property of the political subdivision to be flown at half-staff during such day of mourning.

    ON FEBRUARY 28, 2011, THE HOUSE SUBSTITUTED SENATE BILL 34 FOR HOUSE BILL 47, ADOPTED AMENDMENT #1, AND PASSED SENATE BILL 34 AS AMENDED.

    AMENDMENT #1 rewrites the present law provisions, described above in the bill summary, regarding the governor proclaiming a day of mourning in any month in which one or more death notifications for Tennessee national guard members are provided. This amendment instead requires the governor to proclaim a statewide day of mourning for any member of the armed services who dies as a result of injuries sustained from a service connected, combat-related cause.
