Taxes, Gasoline, Petroleum Products - As introduced, restricts the use of state gasoline tax revenues distributed to the highway fund, counties, and cities to the construction, improvement, and maintenance of highways and bridges; prohibits the use of such revenue for pedestrian, bicycle, and other nonvehicular facilities. - Amends TCA Title 9; Title 54; Title 55 and Title 67, Chapter 3.

    Other Fiscal Impact - According to the Department of Transportation, this bill would result in a violation of the Americans with Disabilities Act and the Rehabilitation Act and would jeopardize federal funding from the Federal Highway Administration. The Department anticipates receiving $874,863,555 in FY16-17 and $893,770,525 in FY17-18. Further, the bill could result in a decrease in federal funding available to municipalities. The extent and timing of any such decreases cannot be determined with reasonable certainty.


    Bill Summary

    This bill requires that gas tax revenues distributed to counties, cities, and the highway fund be used for specific projects.

    Under present law, gas tax revenue is distributed as follows:

    (1) Amounts required to be paid to the debt service fund;
    (2) From amounts designated in (3)-(5) below to counties, cities, and the highway fund, one percent is subtracted from counties and cities and two percent from the highway fund, and is paid to the general fund for expenses of administration;
    (3) 28.6 percent of total taxes collected to be paid to counties;
    (4) 14.3 percent of total taxes collected to be paid to municipalities; and
    (5) Any funds remaining to be paid to the highway fund.

    This bill requires that revenues distributed under (3)-(5) above be used solely for the construction, improvement, and maintenance of highways, bridges, and other transportation infrastructure for public vehicular use. Under this bill, no such revenue may be used for a right-of-way or other facility that is for public non-vehicular use, like pedestrian and bicycle trails. This bill states that it does not prevent the state or a county or city from using federal funds made available solely for the construction and upkeep of such facilities, as long as revenues from the gas tax are not used as the required match for the federal funds or to otherwise ensure the state's use of the federal funds for such purpose.
