    Bill Summary

    This bill creates the Class C misdemeanor of operating a vehicle within a bicycle lane or other portion of the roadway set aside for the exclusive use of bicycles, except under the following situations:

    (1) When parking or stopping the vehicle on the right side of the roadway or the roadway's shoulder or berm when otherwise authorized by present law; or
    (2) When turning into an intersecting or adjoining highway, drive, road, or driveway.

    This bill prohibits drivers from passing another vehicle on the right if such action causes the vehicle to pass within a bicycle lane or other portion of the roadway set aside for the exclusive use of bicycles.

    ON MARCH 7, 2016, THE SENATE ADOPTED AMENDMENT #1 AND PASSED SENATE BILL 1697, AS AMENDED.

    AMENDMENT #1 specifies that a carrier of passengers for hire or other motor vehicle used to provide public transportation may only be parked, stopped, or left standing within a bicycle lane temporarily when loading or unloading passengers and when the area adjacent to the right-hand edge or curb of the roadway that is otherwise designated or primarily used to load or unload passengers is obstructed.

    This amendment adds an exception for persons yielding the right-of-way to, or temporarily parking or stopping upon the approach of, an authorized emergency vehicle or police vehicle.

    This amendment specifies that this bill will not preempt or otherwise affect an ordinance or resolution governing the parking, stopping, or standing of motor vehicles in bicycle lanes that is more restrictive than this bill, whether enacted or modified prior to, or on or after, the effective date, by a municipality or county, including a county with a metropolitan form of government.

    ON MARCH 7, 2016, THE HOUSE SUBSTITUTED SENATE BILL 1697 FOR HOUSE BILL 1487 AND REFERRED SENATE BILL 1697 TO THE HOUSE CRIMINAL JUSTICE COMMITTEE.

    ON APRIL 4, 2016, THE HOUSE FURTHER CONSIDERED SENATE BILL 1697, ADOPTED AMENDMENT #2, AND PASSED SENATE BILL 1697, AS AMENDED.

    AMENDMENT #2 rewrites the penalty provisions of this bill to provide that any person failing to conform to this bill will receive a warning citation on first offense and be liable for a fine of $20.00 on second offense, and $50.00 on third and subsequent offenses.
